Acceptance of Terms

By accessing or using Artist Kit (the "Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

Description of Service

Artist Kit is a page builder for DJs and music artists that lets you create and host a public profile with your music, gigs, and links.

We may add, modify, pause, or remove features at any time for product, security, legal, or operational reasons.

Accounts and Authentication

Account creation and authentication are powered by Supabase. You are responsible for maintaining the confidentiality of your credentials and for activity under your account.

Payments and Subscriptions

Paid features and subscriptions are processed by Stripe. Fees are charged as described at the time of purchase, and refund or cancellation terms are described in your subscription details.

We may update pricing with notice. Continued use after a pricing change means you accept the updated pricing.

Acceptable Use

You may not use the Service to violate laws, infringe rights, distribute malware, send spam, impersonate others, publish fraudulent or harmful material, or attempt unauthorized access to systems.

You may not publish content or links that infringe copyright, trademark, privacy, publicity, or other legal rights.

We may suspend or terminate access for conduct that violates these terms or harms the Service or others.

Intellectual Property

You retain ownership of content you create and submit. By using the Service, you grant us a worldwide, royalty-free license to host, store, reproduce, display, distribute, and operate that content as needed to provide the Service.

You represent and warrant that you own or have all rights, permissions, licenses, and consents needed to publish any content you upload, embed, or link through your profile, including music, images, videos, logos, names, likenesses, and any third-party material.

Artist Kit branding, design, and service code (excluding your content) remain our intellectual property.

Artists Are Responsible for Their Content

Artists are solely and fully responsible for everything they publish on their Artist Kit profile. This includes — without limitation — music files, lyrics, cover art, photographs, videos, biographical text, gig and tour listings, venue names, contact information, social and streaming links, and any third-party material referenced or embedded on the profile.

Artist Kit is a self-service publishing tool. We do not create, pre-screen, edit, fact-check, verify, license, endorse, or take editorial responsibility for any user content. We make no representations or warranties about the accuracy, legality, originality, safety, ownership, or quality of any user content, and we are not liable for it or for any loss or damage arising from anyone's reliance on it.

By publishing content through the Service, you confirm that you alone are responsible for it and that you have obtained every right, license, permission, consent, and clearance required — including from any co-writers, performers, producers, labels, publishers, sample owners, photographers, designers, venues, and other rights holders. Disputes about user content (including ownership, royalties, splits, credits, takedown demands, defamation, or publicity claims) are between the user who posted the content and the complaining party.

Artist Kit acts only as a neutral host. References on a user's profile to third-party works, samples, recordings, artist names, venues, labels, festivals, or events do not imply any affiliation with, sponsorship by, or authorization from those third parties unless the user has independently obtained such rights.

We may, but are not obligated to, review, refuse to publish, remove, or disable access to any content that we believe in good faith violates these terms, applicable law, or the rights of others. Taking or declining such action does not make us responsible for user content or for monitoring the Service.

Reporting Content Concerns

If you believe content hosted on the Service infringes your rights — including copyright, trademark, publicity, privacy, or other legal rights — or is otherwise unlawful, harmful, defamatory, or violates these terms, contact us at hello@artistkit.co.

Please include: (a) your contact details, (b) the URL or identification of the content at issue, (c) the right or rule you believe is being violated, (d) a description of the basis for your claim, and (e) for copyright claims, a statement that you have a good-faith belief the use is not authorized and that the information in your notice is accurate.

We will review valid reports and may remove or disable access to material and terminate repeat infringers where appropriate. We may share the substance of your report with the user who posted the content. Submitting false or misleading reports may itself give rise to liability.

Indemnification

You agree to defend, indemnify, and hold harmless Artist Kit and its officers, employees, contractors, and affiliates from and against any and all claims, demands, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) content you upload, publish, or link through the Service; (b) your use of the Service; (c) your violation of these terms; or (d) your infringement or alleged infringement of any third-party right.

We reserve the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which case you agree to cooperate with our defense.

Third-Party Services and Links

The Service may include links to or integrations with third-party platforms such as streaming, social, ticketing, and analytics services. Those services are operated by third parties and subject to their own terms and privacy policies.

We are not responsible for third-party services, including their availability, content, policies, practices, or any transactions you enter into with them.

Termination

You may stop using the Service at any time. We may suspend, restrict, or terminate your account and remove content for legal, operational, security, abuse-prevention, or terms-related reasons.

Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, or uninterrupted availability.

We disclaim all responsibility for user content and for any conduct of users or third parties on or off the Service. We do not guarantee that the Service will be free from errors, viruses, or harmful components, and you use the Service at your own risk.

Limitation of Liability

To the maximum extent permitted by law, Artist Kit and its affiliates are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or use.

Our total liability for any claim related to the Service will not exceed the amount you paid us in the twelve months before the claim.

Governing Law and Disputes

These terms are governed by the laws of the jurisdiction in which Artist Kit operates, without regard to conflict of law principles. Disputes are resolved in the courts of that jurisdiction unless applicable law requires otherwise.

Changes to Terms

We may update these Terms of Service from time to time. Updated terms are posted on this page with a revised last-updated date.
